1. Purpose

These terms govern the subscription to paid plans of the Proba Bet service, offered by MFT Andorra LLC, 111 NE 1st Street, 8th Floor, Suite 89198, Miami, FL 33132, United States, EIN 35-2926144 ("we"). They supplement the terms of use and the privacy policy.

2. Description of the service

Proba Bet is decision-support software for adult sports bettors: estimated probabilities, detection of misaligned odds, combinations across bookmakers, stake calculation and tracking of the bets logged by the user (result and, depending on the plan, live score and live win chance). The service takes no bets and guarantees no winnings.

3. Plans and prices

Three paid plans are offered, as monthly or yearly subscriptions: Starter, Pro and Sharp. Current prices are shown on the Pricing page before any subscription, in euros; they may be adapted to the user's billing country; they are final prices: no VAT or other tax is added at checkout. A free plan (Free) exists with no time limit. We may change our prices with 30 days' notice by email; the change applies from the next renewal.

4. Trial period

Every new account receives a 14-day free trial with access to the Pro plan, without a payment card. At the end of the trial the account automatically switches to the Free plan; nothing is charged without the explicit subscription to a paid plan. One trial per person: it is not available to an email address that has already had a trial, nor when two trials have already been opened from the same internet connection in the past 90 days; the account then goes straight to the Free plan.

5. Order and payment

Subscription is completed online through our payment provider Stripe. We never have access to card numbers. Payment is due at the start of each period (month or year). If a payment fails, the user is informed by email and the charge is retried for 3 days; failing that, the subscription is suspended and the account returns to the Free plan, without deletion of data.

6. Term, renewal and cancellation

The subscription is entered into for the chosen period and renews automatically for an identical period. The user may cancel at any time, free of charge, from their "Account" area (management portal). Cancellation takes effect at the end of the current period; access is maintained until that date. A plan change during a period is prorated. Deleting the account from the "Account" area cancels the current subscription immediately, with no further charge and no refund of the period already started (subject to the right of withdrawal, article 7).

7. Right of withdrawal and guarantee

In accordance with consumer regulations, the user has a 14-day withdrawal period from their first payment. By subscribing, the user requests immediate access to the service; if they withdraw within this period, we refund the first payment in full on simple request to info@proba.bet, no questions asked. Subsequent renewals are not refundable, as the user may cancel before each due date.

8. Availability

We aim for 99.5 % availability excluding scheduled maintenance. The service depends on third-party data and hosting providers; we cannot be held liable for interruptions caused by those third parties or by force majeure.

9. Liability

The service provides statistical estimates, not advice. The scores, live win chances and results shown in bet tracking come from third-party sources and may lag by a few minutes: they are indicative only, and only the betting operator's settlement is authoritative. Betting decisions belong to the user. To the extent permitted by law, our liability is limited to the amounts paid over the last twelve months. Nothing herein limits mandatory consumer rights.

10. Invoicing

An invoice is issued for each payment and available in the "Account" area.

11. Closing-line guarantee (Pro and Sharp plans)

A bet "beats the close" when the odds at which it was recorded are higher than the fair closing odds computed by the service: Pinnacle's last price before kick-off, margin removed (or Betfair Exchange's when Pinnacle does not price the market). For each calendar month (UTC), we publish on the Results page the share of selection bets recorded during that month, settled and holding a closing line, that beat the close. If, for a month with at least 100 bets settled in this way, that share is below 50%, every user holding a paid Pro or Sharp subscription in force at the end of that month (trial periods excluded) receives a credit equal to the price of one month of their subscription (annual price divided by twelve). The credit is added to the balance of their Stripe customer account within 10 days after the end of the month and is automatically applied to the following invoice(s); it is neither refundable in cash nor transferable. A given month gives rise to only one credit per user. The guarantee concerns the statistical quality of the published probabilities and is in no way a guarantee of winnings. We may change or withdraw the guarantee for future months with 30 days' notice; months already elapsed remain acquired.

12. Referral programme

Every user has a personal referral link in their "Account" area. When a person creates an account from that link (or opens that link while logged in, within 30 days of creating their account) and then pays their first invoice for a paid subscription, the referrer and the referred user each receive a credit equal to the price of one month of the plan subscribed by the referred user, as billed to the referred user (annual price divided by twelve), added to the balance of their Stripe customer account and applied to their following invoices. The referrer's credit is kept if they have no subscription yet and applies to their first invoice. A referred user can be attached to only one referrer, a person cannot refer themselves, and the number of referrals is not limited. Credits are neither refundable nor transferable. We may cancel credits obtained through multiple or fictitious accounts or any other fraud, and change or close the programme for the future with 30 days' notice.

13. Changes to these terms

Any substantial change is notified by email 30 days before it takes effect. A user who refuses it may cancel free of charge before that date.

14. Governing law and disputes

These terms are governed by the laws of the State of Wyoming (United States), subject to the mandatory consumer-protection provisions of the user's country of residence. Prior complaint: info@proba.bet. Consumers in the European Union may use the online dispute resolution platform (ec.europa.eu/consumers/odr). Failing an amicable settlement, the competent courts are those of the consumer's place of residence or those of Wyoming.
